Case management discussions are usually held in discrimination cases. During the case management discussion, the tribunal will want to list the ‘issues’ which the tribunal at the final hearing will have to decide. This is normally just a list of the legal Claims and any issues regarding jurisdiction, such as whether the Claim was lodged in time. If the Claimant is worried that something might get left out, it can be useful to take a draft list of issues to the case management discussion – ideally send it first to the Respondent and get them to agree the list. The Judge at the case management discussion may then work from this draft or even adopt it.
